Thailand: US Embassy Warns Cannabis at Customs Now a Criminal Offence

The US Embassy in Bangkok issued a formal traveller alert on 8 July 2026, warning that Thailand’s customs policy - updated on 17 June 2026 - now classifies cannabis buds as a criminal customs offence carrying penalties of up to 10 years imprisonment and/or a fine of up to 500,000 baht (approximately USD 14,000).

The policy applies under Section 244 of Thailand’s Customs Act. Anyone importing, exporting, or attempting to evade cannabis restrictions at any Thai port of entry is subject to prosecution.

What Has Changed

Thailand legalised recreational cannabis in 2022, creating significant confusion among international travellers about what is and is not permitted. The June 2026 customs reclassification makes the legal position unambiguous:

  • Bringing cannabis into Thailand from abroad is a criminal offence
  • This applies regardless of the legal status of cannabis in your home country
  • Cannabis purchased legally elsewhere - including in countries where it is fully legal - cannot be carried into Thailand
  • Even declaring the substance at customs does not exempt travellers from prosecution

Who Is at Risk

The rule applies to all international arrivals at Suvarnabhumi (BKK), Don Mueang (DMK), Phuket (HKT), and all other Thai international airports and land crossings. Travellers transiting through Thai airports should be particularly careful about baggage contents.

Travellers who have used cannabis in a country where it is legal and may carry residual product - edibles, oils, vape cartridges - in their bags should ensure all such items are removed before departure for Thailand.
